1. Agreement
Your contractual partner for all orders is KARSTADT Premium GmbH, Theodor-Althoff-Str. 2, 45133 Essen.
Our Internet offering does not constitute an offer in the legal sense, but rather an invitation to tender. By placing your order via the “Place Order” button you are submitting a binding tender for the conclusion of a purchase contract. Immediately thereafter you will receive an email about the receipt of your order. Acceptance of your order and therefore also the coming into effect of the agreement take place by means of delivery of the goods.
Please note that your billing address must be in Germany.
We are not a party to any purchase agreements you may enter into via third party websites to which we merely provide access via a link. Such orders are governed by the conditions of the pertinent provider.
2. Shipping / Timing of delivery
Whenever possible, your order will be sent in a single shipment. This does not apply if your order comprises items that must be packaged or forwarded by different modes of transport or that will only become available for delivery at a later date. This will not result in any disadvantages to yourself, as the additional shipping and handling costs will be covered by KARSTADT Premium GmbH. Our regular delivery time is of two to five business days for merchandise in stock; potentially applicable exceptions are stated on the pertinent product page. Delivery times may extend if we should request a payment on account or advance payment. In the event that an item should occasionally not be available for delivery, you will be informed on your invoice or receive a separate written notification.
3. Shipping costs
The following shipping and handling costs apply to deliveries via DHL (standard package, up to 30 kg) for each order:
Germany, merchandise value up to € 150.00: € 10.00
Germany, merchandise value up to € 150.00: Free of charge
Europe: € 15.00
Overseas I (USA) Standard: € 30.00
Overseas I (USA) air freight: € 45.00
Overseas II (Australia, Japan and all other areas): € 65.00
If the intervention of a freight forwarder should become necessary owing to the size or weight of the goods (more than 30 kg), the shipping fee will be calculated on an actual costs basis. The merchandise can be insured at your own cost if desired.
A service charge of €10 will be made for gift vouchers purchased up to a maximum total of €150. This includes the credit card discount and postal costs. Delivery is by registered post at the customers own risk. KaDeWe is not responsible for punctual delivery or loss.
4. Pricing information / Payment options / Retention of ownership
All prices listed comprise statutory VAT and are exclusive of shipping costs. The merchandise shall remain the property of KARSTADT Premium GmbH until full payment therefor has been received. The following payment options apply: Credit Card
5. Encryption
All personal data, such as your address or information about your credit card are encrypted via SSL and can therefore not be tapped into when transmitted over the Internet.
6. Guarantees
The statutory guarantee provisions apply. If the goods you order are used for your own commercial or self-employed work activities, the one-year status of limitations applies to your claims under the statutory guarantee provisions. These guarantee provisions shall remain unaffected by any guarantees provided by the pertinent manufacture or by KARSTADT Premium GmbH.

7. Information concerning data protection and security
Your data will only be used and processed within the scope of the data protection laws in effect from time to time.
Please note that we store your order data, but that after your order has been delivered you will no longer be able to retrieve that information. After you have sent your order, you will receive an email confirming receipt.
8. Battery disposal
Excerpt from the German Battery Disposal Act [Batterie-Entsorgungs-Gesetz]:
Batteries must not be disposed of in the household refuse. As the end consumer, you are legally obligated to return used batteries. They can, for example, be returned free of charge at district collection facilities or at shops. You may also return batteries to us by post or parcel post. Batteries or battery packs that contain toxic substances are marked with a symbol representing a crossed-out refuse bin. Near the refuse bin symbol you will also find the chemical denomination of the toxic substance. Cd means Cadmium, Pb means lead and Hg means mercury.
9. Information concerning returns
The following information concerning returns does not apply if the goods you order are to be used for your own commercial or self-employed work activities.
RIGHT OF RETURN
You may return the merchandise received within 14 days, without needing to state reasons, by delivering it back to us. The 14-day period begins after receipt of the present information in text form (e.g. as a letter, fax or email), but not before the goods are received by the recipient (in the event of repeated delivery of similar merchandise, not before receipt of the first partial delivery) and also not before we have performed on our duty of information in accordance with Article 246 § 2 in conjunction with § 1 Sec. 1 and 2 [Introductory Act to the German Civil Code] and also not before performance on our duties pursuant to § 312e Sec. 1 Subsec. 1 BGB [German Civil Code] in conjunction with Sec. 246 § 3 EGBGB. Only as far as merchandise that is not suitable for mailing via parcel post (e.g. bulky or unwieldy goods) is concerned, you may also request return by collection in writing. The deadline for return is complied with by timely dispatch of the goods or request for collection. In all cases, returns take place at our cost and peril. THE FOLLOWING ARE EXCLUDED FROM THE RIGHT TO RETURN:
- Specially produced merchandise (e.g. engraved items);
- Sealed audio and video recordings, in particular CDs, DVDs, video cassettes, online or LCD games and computer software, insofar as the seals were removed by yourself.
- Gift cards are not returnable. They are not refundable and cannot be redeemed for cash (no partial amounts either).
CONSEQUENCES OF RETURN
In the event of an effective return, any performance already received and/or potential benefits derived (e.g. advantages of use) must be restored and/or reinstated. A deterioration of the merchandise may result in a claim for compensation for loss of value. This shall not apply if the deterioration of the merchandise is due exclusively to examination thereof, such as you would have been able to carry out in a shop. You may in any event avoid the obligation to compensate for loss of value due to a deterioration of the item resulting from use for its intended purpose if you do not use the goods as if they were your property and avoid everything that would impair their value.
The obligation of reimbursement of payments must be fulfilled within 30 days. This period starts to run for you with the date of sending the goods or requesting return collection, and for us with receipt thereof.

10. Special provisions concerning wines and spirits
- Prices: Our prices refer to 0.75 l bottles unless other sizes are stated.
- Vintage or age: In the event that a vintage or age denomination should be sold out, we will send the corresponding item of the following year, provided that it is equivalent in type and price.
